Privacy Policy

Castillo Law Chambers Professional Corporation (“we”, “us”, “our”) is committed to providing services to clients and users of services (jointly “User” or “Users”) in a way that protects and promotes privacy. We recognize the importance of privacy and the sensitivity of private and confidential given that we provide legal services in a lawyer – client relationship.  Since providing legal services involves the collection, use and disclosure of some personal information about the Users, protecting their personal information is a high priority.

We collect personal information during commercial activities and adhere to a privacy policy that complies with the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and its principles. 

Principle 1 — Accountability

We are responsible for Users’ personal information in our possession or custody, including information that has been transferred to a third party as part of the provision of legal services.

We are responsible for Users’ personal information under our control and we are accountable for compliance with the following principles.

Accountability for our compliance with the principles rests with Michel Castillo, even though other individuals as employees or agents may be responsible for the day-to-day collection and processing of personal information.

Principle 2 — Identifying Purposes

We collect the following categories of personal information from Users, depending on the nature of the legal services provided, included but not limited to: Full Name, Email Address, Telephone Number, Marital Status, Employment, Salary, Investments, Property; Banking information, and other personal and private information related to delivery of legal services.

We provide legal services.  We need to collect personal information in order to comply with Law Society of Ontario requirements, in order to give legal advice and representation, and in order to comply with provincial and federal laws. 

We will not use User personal information for purposes other than those identified above without first obtaining your additional consent, unless required by provincial or federal law.

We will document the purposes for which personal information is collected in order to comply with the Openness Principle, Limiting Collection Principle, and Individual Access Principle.

Principle 3 – Consent

Use of this Website DOES NOT create a lawyer – client relationship. We obtain User consent before or at the time we collect personal information.

We do not collect any personal information through our Website.  We may use cookies and may monitor traffic patterns, site usage and related site information (“Website Information”) in order to optimize our Website and to develop internet and social media marketing materials and campaigns.  We may provide Website Information to third parties, such as social media marketing and marketing companies but none of the Website Information includes any identifiable personal information

Users acknowledge and understand that in order to retain our services, in certain circumstances personal information can be collected, used, or disclosed without the knowledge and consent of the User. For example, legal, medical, or security reasons may make it impossible or impractical to seek consent. 

Principle 4 — Limiting Collection

The collection of personal information will be limited to that which is necessary for the purposes identified in this Privacy Policy.

Users’ personal information will be collected by fair and lawful means. 

Principle 5 —Limiting Use, Disclosure, and Retention

Personal information will not be used or disclosed for purposes other than those for which it was collected, except with the consent of the User or as required by law.

Personal information will be retained only as long as necessary for the fulfilment of those purposes set out in this Privacy Policy.

Principle 6 — Accuracy

Personal information will be as accurate, complete, and up-to-date as is necessary for the purposes for which it is to be used in accordance with this Privacy Policy.

Principle 7 — Safeguards

Personal information will be protected by security safeguards appropriate to the sensitivity of the information. Examples of safeguards include but are not limited to use of site restriction, passwords, encryption, antivirus software, etc.

Principle 8 — Openness

Upon request, a User will be provided with specific information about their particular personal information and our policies and practices relating to the management of that personal information.

Principle 9 — Individual Access

Upon request, a User will be informed of the existence, use, and disclosure of their personal information and will be given access to that information.

A User is able to challenge the accuracy and completeness of their personal information and have it amended as appropriate.

In certain situations, Users can be denied access to their personal information.  That may occur, for example, where denial or restriction to access of personal information is required or authorized by law, in order to protect lawyer – client privilege, where it relates to existing or anticipated legal proceedings, where access could cause prejudice, where we have ethical, procedural, or professional duties, etc.  Where the circumstances require that we restrict or deny access, we will explain why. 

Principle 10 — Challenging Compliance

Users have the right to challenge our compliance with this Privacy Policy and PIPEDA. If a User believes that we have not complied with this Privacy Policy or PIPEDA, they may:

Contact our designated individual, Michel Castillo, in writing with the details of your complaint.

We will investigate all complaints and respond in writing within 30 days.

If the complaint is found to be justified, we will take appropriate corrective measures.

If a User is not satisfied with our response, they may escalate the complaint to the Office of the Privacy Commissioner of Canada.

We may change or amend our Privacy Policy from time to time to reflect changes in Law Society of Ontario requirements, requirements under common law or federal or provincial statute, and/or commercial realities.
